One Mid-Michigander told us that a bird built a nest at the top of a ladder that was on the side of his house for only two days, and that another built a nest in his pool skimmer basket inside his pool shed preventing him from opening his pool.

Another area resident said that he just takes down birds nests on his property no matter what. Figuring it's his yard and he owns everything on the property, he doesn't think twice about it. But is it illegal to remove bird nests in Michigan?

Michigan Law on Bird Nests

It turns out that you can face fines for not just removing a bird nest, but simply for disturbing one. According to Michigan Law, 'No person shall molest, injure, kill or capture any wild bird, or molest or disturb any occupied wild bird's nest or the contents thereof.'

So you should avoid nests at all costs, literally. You could get a hefty fine or even spend some time behind bars. Michigan law continues by saying that, 'A violation of this section shall be a misdemeanor, punishable by a fine of not more than $500.00 or by imprisonment for not more than 90 days, or both.'

What You Can Legally Do

In addition to state laws concerning birds and other wildlife there are Federal laws and penalties that could also put you at risk, even in your own backyard. You can remove a nest once a nest is unoccupied, but whether you find a robin's nest or any other bird on your property or elsewhere, you should leave it alone or contact the proper authorities to have it safely removed if possible.
